Terms of Service

These Terms of Service govern your access to and use of Microphone — primarily through SMS, iMessage, and WhatsApp — plus microphone.computer, signed web links we send you (research, inbox, tracking), and related cloud services. Microphone is operated by GEISTS, LLC. By messaging us, using our site, or funding a test, you agree to these Terms and our Messaging Terms. If you do not agree, do not use the service.

Microphone is a team of AI agents you operate by chat. You describe an idea or growth goal; agents gather evidence, propose how to spend your budget, and run tests you approve — such as market research, Meta ad creatives, email outreach, community listening, and hosted landing pages. The product is conversational: you instruct, approve spend and creatives, and receive results by message.

Access is tied to the phone number (and channel) you verify. You agree to provide accurate information, keep signed inbox and setup links private, and use the service only for authorized purposes. You must be able to form a binding contract in your jurisdiction.

You may fund a wallet or pay per test or subscription through payment links we send. Fees and taxes are shown at checkout. Agents allocate budget across channels to maximize learning unless you direct otherwise in chat. We may change pricing or features prospectively; continued use after notice constitutes acceptance where permitted by law.

Subscriptions renew until cancelled. Cancelling stops future charges; it does not automatically refund past spend on delivered tests or third-party media.

When using Microphone, you agree to:

• Only submit content and data you own or are authorized to use
• Comply with applicable law for advertising, email, and messaging (including consent and opt-out rules)
• Comply with third-party platform policies (Meta, carriers, WhatsApp, email providers, etc.)
• Review and approve creatives, outreach, and spend before they go live when we ask for approval
• Not use the service for spam, deception, or illegal products
• Not attempt to reverse engineer, decompile, or extract protected parts of the service
• Not interfere with or disrupt the integrity or security of the service

Your Content

You retain ownership of your ideas, messages, brand assets, and other materials you submit. You grant us a limited, non-exclusive right to process, display, and transmit that content only as needed to operate tests and the service for you.

Microphone's Property

The service, including our software, user interface, branding, and related technology, is owned by GEISTS, LLC and protected by law. These Terms do not grant you any ownership rights in Microphone's intellectual property.

Important: Agents use AI and automation. Outputs can be wrong, incomplete, or misaligned with your intent. Research summaries, ad scripts, email drafts, and budget suggestions are aids — not professional legal, financial, or medical advice. You remain responsible for approvals, spend, outreach sent in your name, and business decisions.

Tests may use third parties (messaging carriers, Meta, payment processors, email delivery, video generation, lead data, and analytics). Your use remains subject to their terms. We do not control their availability, pricing, or enforcement actions.

We may add, modify, suspend, or remove features from time to time. We aim to keep the service available, but we do not guarantee uninterrupted availability or that every feature will remain available indefinitely.

To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law:

• We are not liable for outcomes from ad campaigns, outreach, agent actions, or business decisions made using the service
• We are not liable for any damages resulting from AI-generated content you publish or spend budget on
• Our total liability shall not exceed the amount you paid for the service in the 12 months preceding any claim
• We are not liable for any indirect, incidental, special, or consequential damages

You may stop using Microphone at any time. We may suspend or terminate access if we reasonably believe you have violated these Terms, created legal or security risk, or misused the service.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the new Terms.
